Please read these Terms & Conditions carefully. They apply when you use the website at thecray.com.au, make or manage a reservation, purchase or redeem a gift card, subscribe to updates, contact us, or otherwise deal with The Cray Seafood & Grill.
In these terms, “The Cray”, “we”, “us” and “our” mean The Cray Seafood & Grill and, for a transaction at a particular restaurant, the entity operating that restaurant. “You” means the website visitor, customer or person making a booking.
1. Acceptance and eligibility
By using our website or services, you agree to these terms and any additional conditions shown to you for a particular reservation, offer, event, gift card or transaction. If additional conditions conflict with these terms, the more specific conditions apply to that transaction to the extent of the conflict.
You must be legally capable of entering into an agreement. If you make a booking or purchase for another person or group, you confirm that you are authorised to do so and will make the relevant conditions known to them.
2. Website use
You may use this website for lawful personal or business purposes connected with our restaurants and services. You must not:
- submit false, misleading, fraudulent or unlawful information;
- attempt to gain unauthorised access to the website, accounts, databases or systems;
- introduce malware, scrape the website at an unreasonable rate, or interfere with its security or operation;
- impersonate another person or use another person’s contact or payment details without permission; or
- copy or commercially exploit website content except as permitted by law or with our written approval.
Information on the website is general in nature. Although we aim to keep it accurate, restaurant details, hours, menus, prices and availability can change. Please confirm time-sensitive information directly with the relevant venue.
3. Reservations
- A reservation request is subject to availability. An automated receipt only confirms that we received your request; your table is confirmed when the venue accepts or confirms the booking.
- You must provide accurate contact, guest and booking details and tell us promptly if they change.
- Please arrive at the confirmed time. If you are late, we may shorten the seating period or release the table where reasonably necessary, particularly during busy services.
- To change or cancel a booking, contact the booked venue as early as possible using the details in your confirmation or on our locations page.
- For large groups, functions, special dates or selected services, we may require a deposit, card guarantee, minimum spend, set menu or cancellation fee. Any such requirement will be disclosed before you agree to it or in the specific booking conditions.
- If we need to change or cancel a confirmed booking, we will use reasonable efforts to contact you and offer a suitable alternative or any remedy required by law.
Do not assume a website submission is confirmed if you have not received confirmation. If your booking is time-sensitive, please call the relevant venue.
4. At our venues
Guests must behave respectfully and comply with reasonable venue directions, liquor licensing requirements, dress or event conditions communicated in advance, and applicable law. We may refuse entry or service, or ask a guest to leave, where reasonably necessary for safety, security, responsible service of alcohol, serious disruption, abuse of staff or guests, suspected fraud, or legal compliance.
Children must be supervised by a responsible adult. You are responsible for loss or damage caused by you or members of your party through deliberate, reckless or negligent conduct, subject to applicable law.
5. Menus, availability, pricing and payment
- Menu items, ingredients, portion presentation, trading hours, prices and availability may differ by location and may change due to seasonality, supplier availability or operational requirements.
- Photographs are illustrative and the final dish may vary.
- Unless stated otherwise, prices are in Australian dollars and include GST where applicable.
- Any card surcharge, public holiday surcharge, service charge, minimum spend or other mandatory fee will be disclosed as required by law before payment or ordering.
- You must pay the full amount charged for items ordered or services supplied to you and your party, less any valid discount or credit.
6. Allergens and dietary requirements
You must tell our staff about any food allergy, intolerance or dietary requirement before ordering, even if you noted it in a reservation. Our kitchens handle seafood, shellfish, nuts, gluten, dairy, eggs and other allergens. While we take reasonable care and can discuss available options, shared kitchens, equipment and suppliers mean we cannot guarantee that any item is completely free of traces of an allergen.
Menu descriptions and staff guidance are not medical advice. If an allergy is severe, please speak directly with the venue before your visit so that you can make an informed decision.
7. Gift cards and vouchers
Gift cards may be issued and technically administered through a third-party platform. The conditions presented at purchase, on the card or voucher, and by the issuing platform form part of these terms.
- Purchased gift cards will have at least the minimum validity period required by Australian law, unless a lawful exception applies. The expiry date or validity period will be displayed with the card.
- Gift cards are redeemable only at participating locations and for eligible purchases described in the applicable gift-card conditions.
- Gift cards are not redeemable for cash and change may not be given, except where required by law.
- Treat a gift card like cash. Lost, stolen, damaged or unauthorised-use claims will be handled under the applicable platform terms and law.
- Gift-card purchases are not refundable for change of mind. This does not limit any refund or other right available under the Australian Consumer Law.

8. Promotions, competitions and offers
An offer is subject to its stated dates, participating venues, eligibility rules, exclusions and availability. Unless the offer says otherwise, it cannot be exchanged for cash, transferred, used with another promotion, or applied retrospectively. We may verify eligibility and may refuse or cancel use affected by error, tampering, fraud or misuse. Nothing in this section limits rights that cannot lawfully be excluded.
9. Third-party websites and services
Our website may link to or integrate services operated by third parties, including reservation, gift-card, map, social-media, review, security and payment providers. Their own terms and privacy policies apply when you use their services. We are not responsible for independent third-party content or systems that we do not control, but this does not exclude any responsibility we have under applicable law.
10. Intellectual property
The website and its text, branding, logos, graphics, photographs, videos, menus, layout and software are owned by or licensed to The Cray and are protected by intellectual-property laws. You may view the website and make a reasonable personal copy of information such as a menu or booking confirmation. No other reproduction, modification, publication, distribution or commercial use is permitted without prior written approval, unless allowed by law.
If you send us feedback, reviews, photographs or other material, you confirm you have the right to do so. You permit us to use that material to respond to you and operate our business. We will obtain any additional permission required before using customer material in advertising.
11. Australian Consumer Law and liability
Our goods and services come with consumer guarantees and other rights that cannot be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, and other applicable legislation. Nothing in these terms excludes, restricts or modifies those rights or any liability that cannot lawfully be excluded.
Subject to those non-excludable rights, we are not responsible for loss caused by circumstances outside our reasonable control, your breach of these terms, inaccurate information supplied by you, or your failure to follow reasonable instructions. To the extent permitted by law, we exclude liability for indirect or consequential loss that was not reasonably foreseeable.

12. Privacy and communications
We handle personal information as described in our Privacy Policy. If you opt in to marketing, we may send restaurant news, offers and invitations. You can unsubscribe at any time using the facility in the message or by contacting us. Service messages about a booking or transaction are not marketing and may still be sent where necessary.
13. Website availability and changes to these terms
We may maintain, update, suspend or withdraw all or part of the website. We do not promise uninterrupted or error-free access, but we will take reasonable steps to keep customer-facing services available and secure.
We may update these terms to reflect changes to our services, technology or legal obligations. The updated terms apply from the “Last updated” date shown above and will not retrospectively alter an already confirmed transaction unless permitted by law or agreed with you.
14. Governing law
These terms are governed by the laws of Western Australia and the Commonwealth of Australia. You and we submit to the non-exclusive jurisdiction of the courts of Western Australia and courts entitled to hear appeals from them. You may also have rights to bring a claim in another jurisdiction under applicable consumer law.
If part of these terms is invalid or unenforceable, it will be read down or severed to the minimum extent necessary and the remaining terms will continue to apply. A delay in enforcing a right is not a waiver of that right.
